1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the Poolscape & Sari Landscaping website (poolscape.ae) and the provision of pool construction, landscape architecture, garden installation, and outdoor maintenance services provided by us within the United Arab Emirates.
By accessing our website or entering into a service contract with us, you agree to be bound by these Terms. If you do not agree to all terms and conditions, you must not access our website or engage our services.
2. Scope of Services & Proposals
We provide custom landscape design, swimming pool construction (skimmer, overflow, infinity edge), villa garden landscaping, outdoor pergolas, water features, and scheduled maintenance.
Quotations: All initial design concepts and price quotes remain valid for 30 calendar days from the date of issuance unless specified otherwise in writing.
Permits & Approvals: While we assist in obtaining municipal and developer approvals (e.g., Dubai Municipality, Nakheel, Emaar), the property owner remains responsible for providing valid title deeds, NOCs, and property ownership documentation.
Scope Variations: Any changes or additions requested by the client after final design sign-off will be subject to a written variation order and adjusted pricing.
3. Payment Terms & Milestone Payments
Payment terms for construction and renovation projects are structured according to the agreed project schedule:
Advance Deposit: Required upon contract signing to initiate 3D engineering designs and permit submissions.
Milestone Payments: Tied to completed construction stages (e.g., excavation, MEP rough-in, tiling/plastering, handover).
Final Balance: Payable upon final inspection and project sign-off before operational handover.
Late payments may result in temporary suspension of on-site work until outstanding invoices are settled.
4. Warranties & Guarantee
We take pride in our workmanship and offer warranties tailored to project components:
Structural Shell Warranty: 10-year structural warranty on reinforced concrete pool shells against structural leakage.
Equipment & Pumps: Manufacturer warranties (typically 1 to 3 years) apply to installed pool pumps, filtration systems, and heaters.
Planting & Turf: 30-day replacement guarantee on healthy plants and grass provided automated irrigation systems are maintained properly.
5. Client Responsibilities
Clients are expected to provide:
Unrestricted access to the site during agreed working hours.
Water and electrical power supplies required during construction phase.
Timely review and approval of design drawings and material selection samples.
6. Intellectual Property
All 3D architectural renders, landscape plans, CAD drawings, photography, and website content created by Poolscape & Sari Landscaping remain our exclusive intellectual property. Unapproved commercial reproduction or distribution of our designs without written consent is strictly prohibited.
7. Limitation of Liability
To the maximum extent permitted by UAE law, Poolscape & Sari Landscaping shall not be liable for indirect, incidental, or consequential damages resulting from site delays caused by force majeure events, extreme weather, delayed developer approvals, or pre-existing underground site defects not disclosed prior to excavation.
8. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of Dubai.
9. Amendments & Updates
We reserve the right to revise these Terms at any time without prior notice. Continued use of our website or services following any changes constitutes your acceptance of the updated Terms.
